Generally, you are able to file your divorce in Massachusetts if you meet one of the requirements listed below:

  1.       You have lived here for more than one year. If you have lived in Massachusetts for at least one year, you are eligible to file for a divorce in MA (unless the Court determines that you moved to Massachusetts for the purpose of obtaining a divorce);
  1.     The breakdown of your marriage occurred in MA. If you lived in Massachusetts with your spouse and the cause of divorce occurred in Massachusetts, you may be eligible to file for a divorce in MA. Please note that with respect to a “no-fault” divorce case, the “cause” of your divorce is when you realized that your marriage is over and there is no hope of reconciliation.
